Правительство РФ, похоже, осознало масштаб бедствия и намерено предпринять ряд решительных мер. По оценке вице-премьера Дмитрия Козака, в этом году по сравнению с 2016-м задолженность УК ресурсопоставляющим организациям выросла на 10% и достигла 250 млрд рублей. Интересно, что подавляющее большинство граждан (около 95%) исправно платит за коммунальные услуги. «Так где же деньги, Зин?» — пел Владимир Высоцкий.

Как сообщил вице-премьер, к решению проблемы уже подключились правоохранительные органы, но пока перелома не произошло. Дело в том, что при огромных долгах УК расходуют немалые средства нецелевым образом. Например, одна такая организация, не заплатив за поставленные ресурсы, оказала кому-то благотворительную помощь на 30 млн руб. Другая УК опять же при наличии неоплаченных счетов вывела миллионы за рубеж.

Однако долги управляющих компаний — это лишь часть общей задолженности. Общая же ее сумма перевалила за 1 трлн рублей. Бюджетные организации, особенно компании, связанные с Минобороны, зачастую оплачивают свои коммунальные счета с большой задержкой либо вообще не платят. При этом органы власти нередко не поддерживают истцов-поставщиков коммунальных услуг.

Шальные тарифы

Напомним, в свое время власть сама запустила в действие механизм накопления долгов, который, как швейцарские часы, с тех пор тикает безостановочно. Задолженность уже копится 16 лет — начиная с 2001 года, когда было решено, что плата за коммунальные услуги не должна отставать от инфляции. И понеслось. С 2001 по 2014 годы рост цен в целом составил 245%, а горячее водоснабжение выросло на 942%, газ — на 730%, электроэнергия — «всего» на 638%. Как видно, рост тарифов намного пережал общие инфляционные показатели.

Попытка как-то лимитировать рост цен в ЖКХ больших успехов не имела. Так, в Москве тарифы на тепловую энергию с 2011 по 2017 год выросли более чем в два раза, к этому добавились дополнительные сборы — на капремонт, налог на имущество.

По оценке экспертов, 27% жителей уже не в состоянии справляться с коммунальными платежами. Надежды же на то, что благодаря принимаемым мерам они будут снижаться, не оправдываются. Так, лицензирование УК в целом не привело к повышению качества предоставляемых ими услуг, снижению их себестоимости. Зато управляющие компании оказались в зоне непрерывной административной турбулентности. Так и остался до конца не урегулированным вопрос: кого же УК должны обслуживать? Ведь многоквартирный дом не обрел юридического статуса. Правовые пробелы позволяют недобросовестным коммунальщикам ловить рыбу в мутной воде. Вот задолженность и продолжает свое победное шествие по стране.

Обычно в спорных, сомнительных ситуациях в качестве арбитров выступает суд. Но у нас суды по сходным делам подчас принимают диаметрально разные решения.

Поле для махинаций

По мнению Александра Мачулина из Комитета ТППП РФ по предпринимательству в сфере ЖКХ, в основе всех отношений между контрагентами должны лежать договоры. Как их пропишут, так они и будут исполняться. У нас же не хватает многих важных документов и регламентов — вот и получаются договоры либо неясными, либо необязательными к исполнению. К тому же плохо прочерчены денежные потоки, не всегда понятны их маршруты, где они должны заканчиваться.

Как считает руководитель направления по претензионно-исковой работе дирекции по правовым вопросам «Росводоканала» Юрий Казачков, система агентских соглашений по сбору денег предоставляет широкое поле УК для махинаций. По его данным, каждая пятая УК, с которыми организация имеет дело, является недобросовестной. Собирают деньги у населения, а ресурсоснабжающим организациям их не перечисляют. Вместо этого создают новые УК, куда перекачивают эти средства, а сами демонстрируют нулевой баланс.

«Если не привлекать подобные конторы к субсидиарной ответственности, положение будет сложно изменить», — считает Казачков. По его мнению, сейчас ресурсоснабжающие организации поставлены в сложное положение: они могут отказаться от сотрудничества с такими УК, вот только в этом случае непонятно, кто им вернет долги? Многие такие УК накопили их в больших объемах, и они только рады исчезнуть с рынка.

Недобросовестные УК пользуются еще и тем, что не до конца определены зоны ответственности за сети. У водоканалов часть труб проложена в земельных участках, которые принадлежат домам. «Водоканалу» эта часть водопровода не принадлежит, и сегодня практически ее никто не обслуживает.

Ролевые игры

Долги будут расти до тех пор, пока мы не построим реальную экономику ЖКХ, уверен заместитель председателя Комитета ТПП РФ по предпринимательству в ЖКХ Александр Вербицкий. А в ее основе должен находиться многоквартирный дом со своим юридическим статусом, являющийся объектом управления. Тогда система начинает работать по-иному: все стараются четко определять, на что расходуются деньги, куда, кому и за какие услуги они поступают. Сегодня же жильцы об этом имеют крайне смутное представление. Вот и гуляют деньги, как кошки, сами по себе.

Так, некоторые ТСЖ оплачивают общий единый счет за поставленную услугу, затем каждый его член погашает свою долю. И никаких долгов не возникает. Поэтому так важно объединяться собственникам в кондоминиумы.

Сегодня каждый играет в свою игру. Помимо УК, у которых свой понятный интерес, ресурсоснабжающие организации также пытаются выкачать из этой сферы по максимуму денег. Причем зачастую они действуют в тесной увязке с местными муниципалитетами, стараются сесть на финансовый поток и качать его по максимуму. Отсюда и проистекают многие злоупотребления.

О том, как это выглядит на практике, свидетельствует любопытный пример. В одном большом российском городе был назначен новый мэр. Что же он сделал своим первым указом? Никогда не догадаетесь: уволил прежнего руководителя ЕРЦ и назначил нового — разумеется, из своей команды.

В правительстве, как обычно, надеются решить вопрос улучшением законодательства. Как заявил Дмитрий Козак, подготовлен законопроект, который перекроет возможности УК бесконтрольно распоряжаться деньгами, заплаченными потребителями за коммунальные ресурсы. Есть надежда, что документ может быть принят уже в весеннюю сессию Госдумы.

Впрочем, депутаты приняли столько много всяких законов, что уже мало кто способен разобраться в правовых джунглях. Вот только никак они не складываются в стройную и прозрачную систему. А без нее решить вопрос с долгами ЖКХ невозможно.
